离谱！骗了数百人买假机票，荷兰法院竟然没判他坐牢
据荷兰媒体报道，一名曾通过出售假机票诈骗数百名消费者的男子，最终无需入狱服刑。荷兰阿纳姆上诉法院近日裁定，将其原本10个月的监禁刑期改判为240小时社区服务。案件可追溯至2015年。当年3月，这名现年57岁的男子通过自己经营的网站ZonFly向消费者出售廉价机票。根据荷兰检方(OM)调查，他以这种方式诈骗金额超过23.3万欧元。
受害者在购票后都会收到一张看起来十分真实的电子机票，因此起初并未察觉异常。然而，从同年7月开始，随着出发日期临近，越来越多旅客在网上值机时发现机票无效；还有部分人直到抵达机场准备登机时，才得知自己购买的是假票。
面对突如其来的骗局，不少人只能临时高价重新购买机票，甚至不得不取消原本计划已久的假期。据统计，共有251名受害者向警方报案。
2019年，乌得勒支法院一审认定该男子犯有诈骗罪，判处其10个月监禁。此外，另一名男子因在诈骗发生前“名义上”接手该旅行公司，也被判处4个月监禁。
随后，主犯提出上诉。其律师辩称，涉案旅行社登记在他人名下，因此没有足够证据证明诈骗行为应由其当事人承担，不应被定罪。
不过，阿纳姆上诉法院并未采纳这一说法。法院认为，现有证据足以证明该男子实施了诈骗，因此维持其有罪判决。
但在量刑方面，法院作出了较大调整。
法院指出，如此大规模的诈骗案件，原则上应判处实际监禁。然而，由于距离一审判决已过去约6年半，案件审理时间过长，加之被告如今已经重新融入社会、生活步入正轨，如果此时再执行监禁，将对其造成“过于严重且不成比例的负面影响”。
基于上述原因，法院最终决定撤销原有监禁刑罚，改判其完成240小时社区服务。
这一判决也引发外界关注，不少人认为，对于涉及数百名受害者、诈骗金额高达23万欧元的案件，最终无需入狱服刑，是否足以体现法律的震慑力，仍值得讨论。
